Labor Court Recognizes Injuries of Palestinian Workers

Following an appeal by NIF grantee Adalah; Legal Center for Arab Minority Rights in Israel, Israel’s National Labor Court recognized Palestinian workers who were killed or injured by a rocket attack on the former Gaza settlement of Ganei Tal, as work accident victims.

In June 2005, three Palestinians and one Chinese worker were killed and four Palestinians were wounded by a Kassam rocket attack on Ganei Tal. The attack occurred before the Israeli withdrawal from the Gaza strip.

The dead Chinese worker was registered as a work accident victim by the National Insurance Institute (NII), which at the same time rejected claims by the Palestinians on the grounds that they were living outside of Israel.

The law on this matter has since been amended to stipulate that workers living outside Israel be recognized as work accident victims and National Labor Court President Judge Nili Arad suggested that the NII find a way to compensate the injured Palestinian workers and the dead workers' families. The NII said that it is working with the Ministry of Justice to resolve the problem.
